  • Three in 5 voters (62%) of registered voters say biological men who identify as women should be housed in a men's prison if they commit a crime and are arrested, convicted, and sentenced to jail.
    • Just 16% disagree and say they should be housed in a women's prison.
    • One quarter (23%) are Not Sure.
  • While a plurality of Democrats (47%) say biological men should be housed in a men's prison, 25% say they should be housed in a women's prison if they identify as a woman and 29% of Democrats are Not Sure.
    • Eighty-two percent (82%) of Republicans say they should be housed in a men's prison.
  • Similarly, 62% say female inmates are at risk if biological men who identify as women are housed in women's prisons.
    • Just 21% say the female inmates are not put at risk.
    • More Republicans (83%) than Democrats (45%) say females are put at risk when housed with biological men who identify as women.


This data is from a Napolitan News Service survey of 1,000 Registered Voters conducted online by Scott Rasmussen, March 23-24, 2026. RMG Research, Inc., conducted the field work for the survey. It has a margin of error of +/- 3.1.
